Rent and Discrimination

Dear TZ,

I’m trying to rent an apartment and we found one that’s perfect but the owner said they won’t rent to us because I have a child. Isn’t that discrimination?

In most cases, owners can’t determine the familial status of the renter. In most cases, it’s also illegal for the owner to discriminate based on color, religion, national origin, or sex. But in the case of an owner occupied multi-family dwelling, the owner does indeed have the right to be more selective in choosing the renter. 

If you feel that you’ve been discriminated against, you should file a complaint with Housing and Urban Development. Owner occupants, however, may legally choose the person to whom they rent.
